⸻ Property Ownership & Authorization
By accepting this estimate/quote, the client represents and warrants that they are the legal property owner, authorized agent of the property owner, or otherwise have full authority to approve and authorize the requested work. If the client is not the legal owner of the property, the client assumes full responsibility and liability for any claims, damages, disputes, trespassing allegations, boundary disputes, or unauthorized work arising from the services performed at the client’s request. Mountain Outdoor Service Solution shall be held harmless from any liability resulting from the client’s misrepresentation of ownership or authorization.
⸻ Underground Utilities & Hidden Hazards
Client is responsible for identifying and disclosing any underground utilities, invisible dog fences, septic systems, drain lines, irrigation systems, electrical wiring, fiber/cable lines, propane lines, water lines, or other hidden hazards prior to work beginning. Mountain Outdoor Service Solution is not responsible for damage to undisclosed or improperly marked underground or hidden systems.
⸻ Tree, Plant & Landscape Risk
Tree work, land clearing, grading, excavation, landscaping, and vegetation removal involve inherent risks. While care will be taken to minimize damage, the client understands and accepts that: Existing trees, shrubs, grass, root systems, retaining walls, hardscapes, and surrounding vegetation may experience disturbance or incidental damage. Heavy equipment may leave ruts, compact soil, or disturb surfaces depending on weather and ground conditions. Dead, diseased, storm-damaged, leaning, or compromised trees may react unpredictably during removal or trimming.
⸻ Damage Waiver for Pre-Existing Conditions
Mountain Outdoor Service Solution is not responsible for damages resulting from pre-existing conditions including, but not limited to: Rotten or structurally compromised trees Weak limbs Hidden decay Improperly installed landscaping Existing drainage issues Loose siding, shingles, gutters, concrete, pavement, or masonry Previously damaged surfaces
⸻ Weather & Site Conditions
Quotes are based on visible site conditions at the time of inspection. Additional charges may apply for unforeseen hazards, unsafe working conditions, hidden debris, excessive mud, difficult access, rock, buried materials, or weather-related delays. Services may be postponed or rescheduled due to unsafe weather conditions.
⸻ Debris Removal & Cleanup
Unless otherwise stated in writing: Wood chips, logs, brush, mulch, soil, and debris may remain onsite in designated areas. Final cleanup standards are limited to the scope outlined in the estimate. Hidden debris uncovered during work may require additional labor and disposal charges.
⸻ Pressure Washing / Soft Washing Terms & Conditions
Customer is responsible for providing access to all service areas and a working water source. Soft washing and pressure washing remove dirt, algae, mildew, moss, and organic buildup, but pre-existing stains, oxidation, artillery fungus, rust, calcium, or deep discoloration may not be fully removable. While all reasonable care is taken, Mountain Outdoor Service Solution is not responsible for damage resulting from pre-existing conditions including loose siding, oxidized surfaces, deteriorated wood, cracked mortar, failed seals, aged paint, loose gutters, fragile landscaping, or improperly installed materials. Roof washing may reveal existing shingle wear, granule loss, or prior damage not visible before cleaning. Roof washing and moss treatment results are not always immediate. Organic growth, moss, algae, and staining may continue to break down and weather away over several weeks or months following treatment depending on severity, weather conditions, roof type, and sun exposure. Some heavy moss buildup may require multiple treatments or manual removal for full results. If the property water supply is unable to maintain sufficient flow to keep up with required equipment and buffer tank demand, a water hauling fee of $100 per 200-gallon tank/trip will apply. Customer will be notified before additional hauling charges are incurred. Customer is responsible for informing us of any electrical issues, leaks, loose surfaces, delicate areas, or known property defects before work begins. We are not responsible for water intrusion caused by defective construction, failed seals, improperly sealed doors/windows, or existing structural issues. Any furniture, decorations, vehicles, grills, planters, or personal items should be moved away from work areas prior to service unless otherwise agreed upon. Some cleaning solutions used during soft washing may temporarily affect sensitive vegetation despite preventative measures being taken. Payment is due upon completion unless otherwise agreed in writing. Deposits are non-refundable once scheduling, preparation, or material purchasing has begun. Due to the nature of exterior cleaning, no long-term guarantee is provided against future organic growth or staining caused by weather, moisture, or environmental conditions.
⸻ Boundary Lines & Easements
Client is solely responsible for identifying property lines, easements, and neighboring boundaries before work begins. Mountain Outdoor Service Solution is not liable for disputes involving boundary lines, neighboring properties, or work requested near assumed property lines.
⸻ Change Orders
Any additional work requested outside the original estimate scope may result in additional charges. Verbal approvals, text messages, or on-site authorization from the client may be treated as approval for additional work and billing.
⸻ Payment Terms
Payment is due upon completion unless otherwise agreed in writing. Late payments may be subject to additional fees or collection costs. Deposits are non-refundable once scheduling, material purchases, equipment reservations, or labor commitments have been made.
⸻ Limitation of Liability
To the fullest extent permitted by law, Mountain Outdoor Service Solution shall not be liable for indirect, incidental, special, or consequential damages arising from services performed.
⸻ Acceptance of Terms
Acceptance of the estimate, invoice, electronic approval, signature, text message approval, or authorization to begin work constitutes agreement to all Terms & Conditions listed above HOA Approval Responsibility Client is solely responsible for obtaining any required HOA approvals, permits, permissions, architectural review approvals, or neighborhood authorizations prior to work beginning. Mountain Outdoor Service Solution is not responsible for delays, fines, violations, denied approvals, or required removal/modification of completed work resulting from the client’s failure to obtain proper authorization from an HOA, neighborhood association, municipality, or governing body.
⸻ Fence, Gate & Access Liability
Client is responsible for ensuring adequate and safe property access for personnel, equipment, trailers, and materials. Mountain Outdoor Service Solution is not responsible for damages to fences, gates, posts, underground gate components, landscaping bordering access paths, or concealed obstructions when access routes are restricted, narrow, improperly marked, unstable, or obstructed. Client acknowledges that normal operations involving equipment, trailers, logs, brush, debris, and materials may cause incidental wear or stress to access areas, gates, and fencing systems.
